1. The service
Top Spot is a public online leaderboard. You make a payment in order to display a nickname of your choice and obtain a leaderboard position determined by the amount associated with that payment. Each successful payment creates one independent leaderboard entry.
What you purchase is a display and ranking service — nothing else. Top Spot does not offer, and you do not participate in:
- prizes or cash prizes
- lotteries, gambling or betting
- random drawings or games of chance
- monetary or material rewards for reaching #1
There is no prize for being first. The only thing you receive is the public display of your nickname and position for as long as the service and your entry remain available.
2. Ranking rules
- Higher payments rank above lower payments.
- Where two entries have the same amount, the payment confirmed earlier ranks higher.
- Each payment is a separate entry. Multiple payments made with the same nickname are not aggregated or combined.
- The homepage displays the top 10 entries.
3. Duration of a position
No position is guaranteed for any minimum period. Another user may make a higher payment immediately after yours and move you down the leaderboard. Being #1 does not guarantee that you will remain #1 for any length of time, including for a single second.
4. Payments
- Payments are processed through Stripe Checkout.
- A leaderboard entry is created only after Stripe confirms that the payment succeeded.
- Top Spot does not directly receive or store complete card numbers or CVC/CVV codes.
- You are responsible for checking the amount shown before confirming your payment.
5. Incorrect amounts and refunds
Except where mandatory applicable law requires otherwise, refunds are not provided merely because:
- you entered an incorrect amount
- you intended to enter a different amount
- you changed your mind after paying
- your position was later overtaken by another user
- you misunderstood how long a position would last
Nothing in these terms excludes or limits any refund or remedy that you are entitled to under mandatory consumer protection law. If you believe a payment was taken in error, contact lucatosc97@gmail.com and we will review the matter in good faith.
6. Immediate performance and right of withdrawal
The service is performed immediately after the payment is confirmed: your entry is published on the leaderboard automatically. Before paying you expressly request that performance begins immediately.
Where applicable consumer law permits, you acknowledge that your right of withdrawal is lost once the service has been fully performed. This does not affect any right that cannot lawfully be waived.
7. Nicknames
You must not submit a nickname that contains or constitutes:
- illegal content
- discriminatory slurs or hate speech
- explicit threats or promotion of violence
- sexually explicit content
- abusive or harassing content
- impersonation of another person
- misleading names suggesting affiliation with Top Spot, Stripe, our administrators or any third party
Prohibited nicknames may be rejected automatically before payment. If content bypasses automated moderation, we reserve the right to remove, hide or replace unlawful or prohibited content. Paying does not grant any right to publish prohibited content, and no refund is owed for content removed on these grounds save where mandatory law requires it.
8. Public information
Your nickname, the amount paid, your ranking position and, where displayed, the date and time of your entry are publicly visible to anyone visiting the website. Do not include personal information in your nickname unless you intend it to be published.
9. Chargebacks and invalid payments
We may remove or suspend an entry where the associated payment is reversed, refunded, fraudulent, charged back or otherwise invalid. This does not restrict your statutory rights or your right to raise a dispute with your bank or card issuer.
10. Availability
The service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free availability, and access may be limited or interrupted due to maintenance, outages, hosting failures, payment-provider failures, database or network failures, or other events outside our reasonable control.
11. Abuse
You must not:
- manipulate the leaderboard or its ordering
- bypass or attempt to bypass payment
- exploit vulnerabilities in the website or its infrastructure
- interfere with Stripe or any payment process
- attack, overload or disrupt the service
- impersonate Top Spot or its operators
- use automated or malicious systems against the service
12. Intellectual property
Luca Toscano retains all rights in the website, its software, branding and original content. By submitting a nickname you grant us the limited, non-exclusive right to publicly display that nickname as part of the service you purchased.
13. Age and payment authority
The service is intended for users aged 18 or over, or otherwise legally capable of entering into the transaction. If you pay with a business or corporate card, you confirm that you are authorised to use it.
14. Liability
To the maximum extent permitted by law, our total liability arising out of or in connection with the service is limited to the amount you paid for the entry concerned, and we are not liable for indirect or consequential loss, loss of profit, loss of reputation or loss of ranking position.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot lawfully be excluded, including mandatory consumer rights.
15. Changes to these terms
We may update these terms. The version applicable to a payment is the version published at the time the payment is confirmed. The current version is 2026-08-28.

These Terms are governed by Italian law. If you are a consumer, this does not deprive you of the protection of any mandatory laws or jurisdiction rights applicable in your country of residence.
